二 | ”此前，山东省济南市章丘区检察院办理了一起以投资墓地为噱头、专门骗取老年人“养老钱”的非法吸收公众存款案，该案涉案金额1130万余元，造成116名投资人实际损失994万余元。今年6月，该案的涉案企业和企业负责人被判处相应刑罚后提出上诉。7月22日，法院终审裁定驳回上诉，维持原判。借墓地之名出售理财产品鲁中生态旅游开发有限公司（以下简称“鲁中公司”）经营范围包括园林工程设计与施工，房地产销售代理、墓碑加工与销售，殉葬用品加工与销售等，该公司没有出售墓地资格，所建墓地为公益性质。
三 | 公司法定代表人为张少宗，总经理是韩其芳。2007年初秋，张少宗与某村签订了土地租赁协议，用于建设陵园，租赁土地556亩，每年支付村里租赁费50万元。
四 | 2009年初春，陵园项目获得相关部门批复，鲁中公司正式投入建设。“公司吸收公众存款没有经过批准，主要采取‘一年期预订位’的方式吸收资金，具体就是与客户签订协议，约定客户先交定金，但不指定具体位置，没有福位（墓穴）证，期限一年，到期后可转为购地款也可以退还，公司按照年利率12%支付广告宣传补助费。”张少宗交代说。为了尽快回笼资金，借机敛财，张少宗将陵园项目变成了敛财工具，不仅公开对外销售墓地，而且以墓地为幌子销售投资理财产品。鲁中公司围绕陵园项目向社会公开推出三种产品，分别是“使用”“备使用”和“一年期预定位”。“使用”是指实际购买墓穴，客户签订购买协议后，指定墓穴的位置、面积，公司颁发福位证，不退款也没有利息。“备使用”也叫定位返还，即客户交款定好福位后，定准位置，公司颁发福位证，每年按照高于银行利率2个百分点返还客户损失补助费，五年后，客户如果不愿意持有，可以转让，公司也返还本金。“一年期预订位”是指客户购买后，公司每年按照年利率12%支付客户广告宣传补助费，期限一年，到期后可以续签合同，如果不要墓地能一次性取出本息，这种形式没有确定墓穴，没有福位证，实际是一种理财方式。
五 | 鲁中公司内摆放着远景规划图和宣传产品的彩页，如果客户想投资，业务员会带着他们到墓地实地观看，由专门的讲解员负责讲解宣传。“张少宗和韩其芳让我们主售‘一年期预订位’，说是来款快。
六 | ”鲁中公司市场总监高某说。投资收益让人心动鲁中公司租赁了多处门面房作为服务处，每个服务处都挂有该公司的营业执照、税务登记证、陵园项目的审批手续等，看上去十分正规。“鲁中公司开发的陵园项目有很多人投资，并且有实实在在的墓地，投资很安全，收益也很高，业务员带我参观了建设中的陵园，规模很大，觉得挺正规的，就想购买墓地和投资理财。”被害人刘某说道。2014年10月，被害人郭某通过亲戚郭某某介绍了解到鲁中公司的业务性质，他们决定一起到建设中的陵园看看，当时该公司正在搞免费让客户到香港旅游的活动。“我们看到陵园建得挺好，还有专门的讲解员，他们极力劝我们投资，说投一年公司支付12%的利息。”高利息加上免费旅游让他们动了心，二人共同投了5万元。鲁中公司给郭某和郭某某出具了收款收据和商品预订协议书，按照协议规定，一年到期后他们能拿到6000元利息。结果到期后鲁中公司回复没钱，还把6000元利息转成定金，重新换了单子，金额变成5.6万元。直到案发，郭某和郭某某也没拿回5.6万元本息。不服一审判决，他们提出上诉2021年8月，章丘区检察院以涉嫌非法吸收公众存款罪对鲁中公司及其法定代表人张少宗、总经理韩其芳提起公诉。在该案审理过程中，被告单位诉讼代表人辩解称，鲁中公司将吸收的资金大部分用于建设陵园，支付工程款、广告补贴、业务员工资和提成，偿还客户借款，鲁中公司主观上并非想坑害客户。检察官当庭予以反驳：非法吸收公众存款是指违反国家金融管理法规，未经有关部门依法批准或者借用合法经营形式，通过媒体、推介会、传单、手机短信等途径向社会公开宣传，承诺在一定期限内以货币、实物、股权等方式还本付息或者给付回报，向社会不特定对象吸收资金的行为。本案被告单位的行为完全符合非法吸收公众存款罪的行为特征，已构成非法吸收公众存款罪。该案在审理过程中，张少宗因病死亡，2021年8月23日法庭中止审理该案。
七 | 2022年6月，法庭对该案恢复审理。章丘区法院经审理查明，鲁中公司在未经金融管理部门批准的情况下，以开发“生态陵园”的名义，对外公开宣传，承诺给予高利息、高返利，采用与社会不特定人群签订商品预订协议书销售“一年期预订位”的方式，非法吸收公众存款1130万余元。
八 | 6月22日，法院以非法吸收公众存款罪判处鲁中公司罚金30万元；以非法吸收公众存款罪判处公司直接负责人韩其芳有期徒刑三年六个月，并处罚金10万元。因韩其芳曾在淄博以同样的方式实施非法集资犯罪，2020年5月被法院判处有期徒刑三年，缓刑四年，法院决定撤销其之前的缓刑，决定执行有期徒刑四年，并处罚金15万元。被告单位和被告人提出上诉。7月22日，二审法院作出终审裁定：驳回上诉，维持原判。（涉案当事人姓名均为化名）来源：中国警察网返回搜狐，查看更多责任编辑：
